Resignation Period
Q:
I came on company visa and working here as an accountant from last 3 years I have complete my contract and I resign before few days and gave them one month notice period but my company saying to me that at least you have to give us 3 months notice it is labor law.

A:
As per Labour Law Chapter II Article 75:
If the contract is of an indefinite term, either party may terminate it for a valid reason to be specified in a written notice to be served to the other party at least thirty days prior to the termination date if the workman is paid monthly and not less than fifteen days for others.

Transfer of Sponsorship

Q: I Want to to transfer my sponsorship to other company. I came on company visa and my contract has finished. My company is in yellow category but they are not agree to give me transfer and the company where I want to transfer my sponsorship it is in high green. Will it be approved?

A:  As long as the company is not in the red, you should be allowed to transfer. You may have to pay the transfer fees out of your own pocket.

Computation of end-of-service pay

Q: How is the end of service calculated in Saudi Arabia?

A:
Section Four: End-of-Service Award
Article 84: Upon the end of the work relation, the employer shall pay the worker an end-of service award of a half-month wage for each of the first five years and a one-month wage for each of the following years. The end-of-service award shall be calculated on the basis of the last wage and the worker shall be entitled to an end-of-service award for the portions of the year in proportion to the time spent on the job.
Article 85: If the work relation ends due to the worker’s resignation, he shall, in this case, be entitled to one third of the award after a service of not less than two consecutive years and not more than five years, to two thirds if his service is in excess of five successive years but less than ten years and to the full award if his service amounts to ten or more years.

Exit Re-entry Issue to Saudi Arabia
Q: I have availed my vacation from KSA, unfortunately I did not return to KSA within stipulated time. My iqama validity has also been expired. Currently I got an offer in KSA. Is it possible to retune to KSA without any problem?
My new visa also stamped from Saudi consulate. But when I checked in online status, still my status is showing “Absent from Work” . I am afraid to if any problem will come while entering KSA at the Airport during Finger Time which was done earlier also.
A: It appears that your old employer may have entered a “haroob complaint” against you. It is likely that you will face difficulties if you try and enter the country under the sponsorship of a new employer. You should have contacted your old sponsor when your visa expired and certainly should not have allowed your visa (residence permit expiry date) to expire.
The correct procedure is to leave on a final exit visa and return on a new visa (where there is no objection from the old sponsor) or apply for transfer of sponsorship (AN).

Practice of work by the dependants such as wives and children
He shall be fined as follows:
• 1000 S.R. first instance.
• 2000 S.R. second instance.
• 3000 S.R. third instance and the issue will be referred to the Minister of Interior for his direction towards termination of the violator's Iqama and deport him.

Reentry expired

Q: What are the recent changes in re-entry visa rules as I failed to enter in the kingdom and my visa expired my iqama also expired I have been in India for 1 year. Shall I have to wait for 2 years as conventional ban earlier ?

A: You should be entitled to work in the Kingdom subject to obtaining a new visa from your old sponsor/new sponsor. The only circumstance in which you will not be permitted to work is where you have signed up to non-compete provisions in the employment contract with your old employer.

Fake Huroob (abscond) reporting
Q: 
I took transfer from my old sponsor And submitted all papers to the new company but my old sponsor put me in Huroob (absconding). now my new company cannot get transfer and labour office says we don not have the system to remove huroobs...

A: You can no longer ask your old sponsor to cancel the "huroob" and the only way that this can be currently lifted is by way of application to the Labour Committee upon the successful determination of a law suit in your favour. You will need to find out why your old sponsor filed a "huroob" against you after agreeing to transfer your sponsorship and where unlawful, challenge this action by filing a law suit at the Labour Committee.

Unlimited Contract
Q: How many years I need to work with my sponsor and my contract paper only shows the date of employment. Finishing date of my contract not mentioned?

A: If your contract does not have an expiration date then the expiration date of your working permit shall be the expiration date of the contract, according to Article (37) of the Labor Law. In order to work for another employer, you need to finish your contract with your current employer, unless he violates Nitaqat Guide or the Labor Law, and you have a valid reason to terminate your contract and transfer your sponsorship to another employer, then you can file a complaint before the Labor Office in this regard.
